TERMS OF SERVICE

Effective Date: 18th of January 2026

These Terms of Service (“Terms”) govern your access to and use of 4fans.tv (the “Platform”, “Website”), operated by HDA DIGITAL LTD, Tax Identification Number 60168445G, Registration Number HE 474848, with its registered office at 30 Pireos Street, Floor 1, Office 1, Strovolos, 2023 Nicosia, Cyprus (“Company”, “we”, “us”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms should be read together with our

1. Eligibility & Age Requirement

Access to the Platform is strictly limited to individuals who are 18 years of age or older or the age of majority in their jurisdiction, whichever is higher.

By creating an account or using the Platform, you confirm that:

• you are at least 18 years old,

• accessing adult content is legal in your jurisdiction.

Users are required to confirm their age during registration. All content on the Platform is protected by paywalls and is not publicly accessible.

2. Accounts & Registration

2.1 One Account Policy

Each individual may maintain only one account on the Platform:

• one user (fan) account and/or

• one content creator account.

Creating multiple accounts, attempting to bypass suspensions or bans, or registering accounts on behalf of other individuals is strictly prohibited.
The Company may use technical and behavioral methods (including IP analysis, device fingerprinting, and usage patterns) to detect violations.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. The Company is not responsible for unauthorized access resulting from your failure to secure your account.

3. Right to Suspend or Terminate Accounts

The Company reserves the absolute right, at its sole discretion, to:

• suspend,

• restrict,

• or permanently terminate any account,

with or without notice, and with or without providing a reason, where permitted by law.

In cases of serious violations, including illegal activity or prohibited content, termination may occur immediately and without prior warning.

4. Prohibited Content & Conduct

The following content and behavior are strictly prohibited on the Platform:

• any depiction of persons under the age of 18;

• any form of violence, including physical, psychological, or verbal abuse;

• non-consensual content, including so-called “consensual non-consent (CNC)” scenarios or roleplay suggesting lack of consent;

• content involving coercion, threats, manipulation, or exploitation;

• any person appearing in content without full awareness and voluntary participation;

• hate speech, harassment, or intimidation;

• impersonation, use of fake identities, or misrepresentation of personal information;

• illegal acts or content violating applicable laws.

All individuals appearing in content must do so knowingly, willingly, and without pressure.

5. User-Generated Content

Users and content creators are solely responsible for the content they upload, publish, or distribute.

The Company:

• does not act as the primary producer of user-generated content,

• reserves the right to remove or restrict any content at its discretion,

• makes no guarantee regarding the availability or permanence of any content.

6. Payments, Subscriptions & Billing

The Platform offers digital content through subscriptions, pay-per-view content, and other paid features.

• Subscriptions may be cancelled at any time.

• All sales of digital content are final.

• Refunds are not provided except where required by law or in cases of proven fraud or technical error.

Payments are processed by third-party payment providers. The Company does not store payment card details.

7. Off-Platform Payments

Any attempt to solicit, request, or accept payments outside the Platform for content or services offered on 4fans.tv is strictly prohibited.

Violations may result in account termination and forfeiture of earnings.

8. Taxes & Financial Responsibility

The Company does not act as a tax agent or withholding entity.

• All payouts are made gross.

• Users and content creators are solely responsible for declaring and paying any applicable taxes in accordance with their local laws.

• The Company does not provide tax advice.

Further details applicable to content creators are set out in the Content Provider Agreement.

9. KYC / AML Verification

Content creators are subject to identity, age, and liveness verification conducted through SumSub, a third-party verification provider.

Verification may include:

• government-issued identification,

• biometric checks,

• liveness verification.

Failure to complete or maintain verification may result in account suspension or withholding of payouts.

10. Forfeiture of Earnings

In cases involving serious violations of these Terms, including but not limited to:

• underage content,

• non-consensual content,

• fraud,

• human trafficking or exploitation,

the Company reserves the right to withhold or forfeit any unpaid earnings and to report such activity to relevant authorities.

11. Third-Party Services

The Platform relies on third-party services, including payment processors and verification providers. The Company is not responsible for the actions or failures of such third parties.

12. Limitation of Liability

The Platform is provided “as is” and “as available”.

To the maximum extent permitted by law, the Company shall not be liable for:

• loss of income, data, or reputation,

• service interruptions,

• user-generated content,

• actions of other users or third parties.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or losses arising from your use of the Platform or violation of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Cyprus.
All disputes shall be resolved exclusively by the courts of Nicosia, Cyprus.

15. Changes to Terms

The Company reserves the right to modify these Terms at any time. Changes take effect upon publication with an updated Effective Date.
